1. INTRODUCTION AND ACCEPTANCE OF TERMS
These Terms & Conditions (“Terms”) constitute a legally binding agreement between the user and Dental Gate Albania SHPK (“the Company”, “we”, “us”).
By accessing or using the website, forms, consultation services, or any communication channel of the Company, the user confirms that they:

have read and understood these Terms;

accept them in full;

agree that they form a binding agreement.
If the user does not agree with these Terms, they must immediately stop using the services.

2. LEGAL NATURE OF THE SERVICE (FACILITATION ONLY)
The Company provides coordination and facilitation services for dental treatments for international patients in Albania.
The Company:

is not a healthcare provider;
-
is not a dental clinic;
-
does not perform clinical diagnosis;
-
does not provide medical treatment;
-
does not replace professional advice from licensed dentists.

All medical services are provided exclusively by independent and licensed dental clinics, which are not under the control, management, or responsibility of the Company.

3. NO DOCTOR–PATIENT RELATIONSHIP
Use of this platform does not create any doctor–patient relationship between the user and the Company.
Any doctor–patient relationship is established exclusively between the patient and the relevant dental clinic after clinical evaluation and acceptance of treatment.

4. EXTENDED MEDICAL DISCLAIMER
Any information provided by the Company, including:

preliminary assessments;
-
treatment suggestions;
-
communications with patients;
-
informational materials;
is strictly for informational and guidance purposes only.

The Company does not guarantee:

clinical accuracy of preliminary assessments;
-
suitability of any treatment;
-
medical outcomes;
-
success of dental procedures.

Medical decisions are the exclusive responsibility of licensed dental professionals and clinics.

5. LIMITED LIABILITY (MAXIMUM LIABILITY EXCLUSION)
To the maximum extent permitted by law, the Company shall not be liable for:

any direct or indirect damages;

medical complications;
-
adverse treatment outcomes;
-
delays or cancellations of treatment;
-
actions or omissions of partner clinics;
-
financial, physical, or emotional losses.

The user acknowledges that all medical treatments involve risks, and such risks are solely the responsibility of the clinic and the patient.
6. INDEMNIFICATION
The user agrees to defend, indemnify, and hold harmless the Company, its directors, employees, and partners from and against any:

legal claims;
-
lawsuits;
-
damages;
-
losses;
-
expenses (including legal fees);
arising from:
-
use of the services;
-
medical treatments performed by partner clinics;
-
information provided by the user;
-
any decision made by the patient based on information from the platform.
7. ROLE OF THE COMPANY
The Company acts solely as:
-
an intermediary;
-
communication coordinator;
-
facilitator between patient and clinic;
-
provider of logistical information.

The Company is not a party to the medical contract between the patient and the clinic.
8. ASSUMPTION OF RISK
The user expressly acknowledges that:

dental treatments may involve risks;
-
outcomes may vary from patient to patient;
-
no results are guaranteed;
-
decisions are made independently with the relevant clinic.
9. PARTNER CLINICS (INDEPENDENT THIRD PARTIES)
Partner dental clinics are independent legal entities and are fully responsible for:
-
diagnosis;
-
treatment;
-
medical procedures;
-
clinical outcomes.

The Company does not control or guarantee their professional conduct.
10. COMMUNICATION AND MEDICAL DATA
The user may submit:

dental photographs;
-
radiographs (X-rays);
-
medical documents;
-
personal information.

By submitting such data, the user consents that it may be:

processed for preliminary evaluation;
-
shared with partner clinics;
-
stored for coordination purposes.

11. INTERNATIONAL SERVICES
The user acknowledges that:

services are provided in an international context;
-
medical standards may vary by country and clinic;
-
communication may take place via third-party platforms (WhatsApp, email, etc.);
-
data may be transferred internationally.
12. SMILE REWARDS PROGRAM
-
Points are valid for 12 months;
-
Points are personal and non-transferable;
-
Points may be used by close family members;
-
Points have no monetary value;
-
The Company reserves the right to modify or terminate the program at any time without liability.
13. DISCLAIMER OF WARRANTIES
The Company does not guarantee:
-
medical results;
-
availability of clinics;
-
accuracy of third-party information;
-
uninterrupted service availability.

Services are provided on an “as is” and “as available” basis.
14. LIMITATION OF FINANCIAL LIABILITY
In any case, the total liability of the Company shall not exceed the amount paid by the user for facilitation services, if any.
15. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Republic of Albania.
Any disputes shall be resolved by the competent courts in Albania, unless the parties agree to alternative dispute resolution (mediation or arbitration).
16. CHANGES
The Company reserves the right to modify these Terms at any time. The updated version will be published on the official website and becomes effective immediately.
